Introduction

Untold Japan is a tour guide company based in Japan that provides personalized travel experiences in the country. The Company’s mission is to offer visitors an authentic, immersive, and memorable experience in Japan. By booking a tour or using our services, you agree to be bound by these terms and conditions (“Terms”). These Terms set forth the legal framework between you and the Company, and it is important that you take the time to read and understand them before making a booking.

 

Tour Bookings

 

2.1 Booking Process

To book a tour with Untold Japan, you can either complete the online booking form on our website or contact us directly to request a tour. If you are booking online, simply follow the steps outlined on the website and provide the required information. If you prefer to speak with a representative, simply call or email us, and we will assist you with the booking process.

 

Once we receive your request, we will send you a tour proposal that outlines the itinerary, inclusions, and cost of the tour. If you agree to the proposal, we will send you a payment invoice. Payment must be received in full before the tour is confirmed and scheduled. The Company accepts various payment methods, including credit card, PayPal, and bank transfer.

 

2.2 Changes and Cancellations

We understand that plans can change, and that you may need to alter or cancel your tour for various reasons. If you need to change or cancel your tour, please contact us as soon as possible. The following cancellation fees will apply:

A non-refundable deposit of $500 per person will be taken at the time of booking. This deposit is designed to secure your tour and to cover the costs associated with processing your booking.

If you cancel your tour within 90 prior to the start date, 20% of the tour fee will be taken as a cancellation fee. This fee is designed to cover the costs associated with rebooking the tour, as well as to compensate the Company for the time and resources that were invested in preparing for your tour.

If you cancel your tour within 30 days prior to the start date, there will be no refund.

If payment is not received within 45 days of your scheduled start date, we reserve the right to cancel your tour without refunding the deposit. Any cancellation fees incurred from hotels or other cancellations will either be deducted from the initial payment or invoiced separately.

In the event of unanticipated weather conditions, such as a typhoon, while on tour, the Company will offer a contribution of ¥40,000 to be used for resulting unforeseen changes to hotel bookings or transportation. The remaining expenses will be the responsibility of the guest on tour.

If the tour is cancelled due to weather, natural circumstances, or the fault of the Company, a full refund will be issued, excluding the initial deposit. The Company will make every effort to provide tours as scheduled, but it is understood that circumstances beyond our control can arise that may necessitate the cancellation of a tour. In such cases, we will provide a full refund as a gesture of good faith.

 

2.3 Tour Prices

Tour prices are based on the itinerary and inclusions specified in the tour proposal. Prices are subject to change without notice, and may be affected by various factors, such as currency fluctuations, fuel surcharges, and government taxes. The Company will notify you of any significant price changes before payment is due, and you will have the option to either proceed with the tour or cancel without penalty.

 

2.4 Tour Inclusions and Exclusions

The tour inclusions and exclusions are specified in the tour proposal, and it is important that you review this information carefully before making a booking. In general, the tour fee covers the services of a professional tour guide, activities and cultural experiences, pre-booked and pre-arranged transportation within Japan, accommodations, Untold Japan’s 20% agency fee, sales tax (10%), and handling fee (1.1%).

Please note that the tour fee does not cover expenses incurred outside of the tour, such as travel to and from the tour start and end points, visas, insurance, and personal expenses.

 

3. Liability

The tour company will not be held liable for any personal injury, death, or loss of personal property that occurs during the tour. Customers are responsible for their own personal safety and property, and should take appropriate measures to protect themselves and their belongings.

 

In the event of any accidents or incidents that occur during the tour, the tour company will provide appropriate assistance and support to the affected party. However, the tour company will not be held liable for any costs incurred as a result of such incidents.

 

It is important to note that the tour company reserves the right to make changes to the itinerary, routes, or other aspects of the tour as necessary, for reasons including but not limited to weather conditions, road closures, and other circumstances outside of the tour company's control. The tour company will not be held liable for any costs incurred as a result of such changes.

 

In the unlikely event of a tour being cancelled by the tour company, customers will receive a full refund, excluding any non-refundable deposit. The tour company will not be held liable for any additional costs incurred as a result of the tour cancellation, such as travel or accommodation expenses.

 

By agreeing to these terms and conditions, customers acknowledge and accept the limitations of liability as outlined above. This helps ensure a clear understanding of the rights and responsibilities of both the tour company and the customers, and helps provide a safe and enjoyable experience for all participants.

 

4. Insurance

The tour company strongly recommends that all customers purchase appropriate travel insurance to cover any unexpected incidents or accidents that may occur during the tour. This can include coverage for medical expenses, trip cancellations, and lost or stolen property.

 

5. Data Protections

The tour company takes the protection of customer data very seriously, and is committed to complying with all applicable data protection laws and regulations in Japan. The company will only collect and use personal data in accordance with its Privacy Policy, which outlines the purposes for which customer data will be collected and used, and the rights of customers to access and control their personal data.

 

6. Governing Law

These terms and conditions will be governed by and construed in accordance with the laws of Japan. Any disputes arising from or in connection with these terms and conditions will be subject to the exclusive jurisdiction of the courts of Japan.

 

7. Dispute Resolution

In the event of any disputes arising from or in connection with these terms and conditions, the parties will first attempt to resolve the dispute through friendly and informal negotiations. If the dispute cannot be resolved through negotiations, the parties may choose to refer the dispute to mediation, arbitration, or any other form of alternative dispute resolution.

 

8. Entire Agreement:

These terms and conditions constitute the entire agreement between the tour company and the customers, and supersede all prior negotiations, understandings, and agreements between the parties. No changes to these terms and conditions will be valid unless agreed to in writing by both the tour company and the customers.

 

By agreeing to these terms and conditions, customers confirm that they have read, understood, and agree to be bound by all of the terms and conditions outlined above. These terms and conditions help ensure a clear understanding of the rights and responsibilities of both the tour company and the customers, and help provide a safe and enjoyable experience for all participants.
